Fixalaan Terms and Conditions

These Terms and Conditions govern all inquiries, quotes, bookings, dispatches, payments, and services arranged through Fixalaan Facilities Management - FZCO (License No. 72896), a company registered with the Dubai Integrated Economic Zones Authority (IFZA), Dubai Silicon Oasis, United Arab Emirates. By requesting a quote, booking a service, using our website, sending a WhatsApp message, or calling us, you (“Customer”) agree to these terms in full.

1. Our Role

Fixalaan Facilities Management - FZCO is a coordination platform that connects customers with independent subcontractors for property maintenance, deep cleaning, AC servicing, painting, grout restoration, handyman repairs, move-out resets, and related services in Dubai. We do not employ the technicians or cleaners directly. All fieldwork is performed by independent subcontractors under separate agreements with us. We remain the single point of contact for the confirmed booking.

2. Booking and Confirmation

Submitting a form, WhatsApp message, call, or quote request does not create a binding contract. A booking is only confirmed when we review your request (photos, description, location, size, and any other details) and issue a written confirmation with the exact scope, price, and scheduled time. We reserve the right to refuse, adjust, or cancel any request at any stage before confirmation.

You are fully responsible for providing accurate, complete, and up-to-date information. Any discrepancy discovered on site may result in revised pricing, additional charges, rescheduling, or cancellation without refund of any deposit or fees already paid.

2.1 Acceptance of Terms

When we confirm your booking via WhatsApp, phone, or any other communication, we explicitly state that our full Terms and Conditions apply and are available at https://fixalaan.com/terms.

By replying "yes", "book", "confirm", sending your location/address, making payment, or otherwise proceeding with the booking after receiving this statement, you accept these Terms and Conditions in full. This acceptance is recorded in the chat history and forms part of the binding agreement. Lack of reading or clicking a link does not invalidate acceptance once you have taken any of the above actions.

3. Pricing and Scope

All prices are based solely on the information and media you provide. If the actual job differs in scope, complexity, condition, or requirements once our subcontractor arrives, we may issue a revised quote or additional charges before continuing. We will inform you first.

Quoted prices include only the confirmed scope and standard materials. Extras (additional rooms, hidden defects, structural work, special materials, landlord approvals, parking fees, extra visits, etc.) will be quoted separately and must be accepted in writing before work proceeds.

4. Payment

Payment terms are stated in the confirmation. We may require a deposit, inspection fee, or full payment before dispatch or start of work. Payment is due as specified. If payment is not made when due, we may postpone, cancel, or withhold completion confirmation, reports, or handover documents until full payment is received.

5. Cancellations and Refunds

Cancellations are only accepted before the subcontractor is dispatched. Once a subcontractor is dispatched or work has started, cancellation is not possible and no refund will be issued for the confirmed scope.

If you cancel after dispatch or after work has begun, you remain liable for the full confirmed price plus any costs already incurred (materials, travel, subcontractor time, preparation). Any refund, if granted at our sole discretion, will be processed after deduction of all incurred costs, administrative fees, and lost opportunity. Refunds are issued through the original payment method within 14 business days.

5.1 Refund Policy Details

Any request for refund after the job has started or been completed will be reviewed on a case-by-case basis at our sole discretion. Refunds, if granted, will be calculated after deduction of all labour, subcontractor, material, travel, and administrative costs incurred, plus a minimum 25% coordination fee. No refund will be issued for change of mind, no-show, access issues, or dissatisfaction with aesthetic results that do not affect the core functionality of the confirmed scope. We do not offer cash refunds for completed work; we may offer remedial work only where the defect is proven to be solely due to our workmanship and reported within 48 hours.

6. Access, Site Conditions, and Customer Responsibilities

You must provide safe, timely, and unrestricted access to the property, working utilities, keys, and any required permissions from building management or landlord. You must disclose all restrictions, hazards, parking limits, and pre-existing conditions before dispatch.

If access is denied, the site is unsafe, or the actual condition differs materially from what you described, we may charge a call-out fee, reschedule, or cancel without refund. You agree to indemnify Fixalaan against any losses, claims, or costs arising from your failure to meet these obligations.

7. Scheduling and Timing

Appointments are scheduled windows, not guaranteed exact times. Traffic, building access controls, prior jobs, weather, material delays, and third-party dependencies may affect arrival and completion. Same-day or urgent requests are subject to availability and may incur additional fees.

You must notify us of any changes as early as possible. Repeated changes, last-minute postponements, or customer no-shows may result in a cancellation fee or loss of the slot.

8. Subcontractors

All fieldwork is performed by independent subcontractors. They are not our employees. We coordinate the booking, but the subcontractor is responsible for performing the confirmed scope. We are not liable for the subcontractor’s independent actions beyond the coordination we provide.

9. Warranty (Limited 1-Year Workmanship Warranty)

We offer a limited 1-year workmanship warranty on the confirmed scope of the job, starting from the date of completion. This warranty covers only defects that are directly and solely caused by the subcontractor’s workmanship and that were not present before the job started.

If a claim is approved after inspection, we will arrange a follow-up visit at our cost, limited strictly to the original confirmed scope. We do not provide monetary refunds under the warranty — only remedial work where possible and at our sole discretion. Any follow-up visit must be scheduled at our convenience and may take up to 14 days depending on availability.

The customer acknowledges that maintenance and repair work involves many variables and achieving a perfect long-term result is not always possible. The 1-year workmanship warranty is offered as a goodwill gesture and does not create any additional legal obligations or guarantees beyond what is expressly stated here.

10. Completion and Concerns

You must inspect the completed job on the same day and raise any scope-related concern immediately with photos. We will address issues that fall strictly within the original confirmed scope. Issues caused by pre-existing damage, hidden defects, or changes requested by you later may require additional payment or a new booking.

11. Liability and Indemnity

To the fullest extent permitted by law, our total liability for any single job is limited to the amount you actually paid to us for that specific confirmed job. We are not liable for indirect, consequential, loss of rent, business interruption, or any damages that cannot be reasonably foreseen.

You agree to indemnify and hold Fixalaan, its officers, and coordinators harmless from any claims, losses, or costs arising from inaccurate information you provided, access issues, site conditions, hazards you failed to disclose, or changes to scope requested by you after confirmation.

12. Communications

You consent to receiving calls, WhatsApp messages, SMS, and emails for booking, updates, payment, and service matters.

13. Governing Law

These terms are governed by the laws of the Emirate of Dubai and the United Arab Emirates.
